Microsoft has had a lot of experience in anti-trust cases. It has been taken to the cleaners in anti-trust cases across the world.
Now it seems to think that it can use that same weapon against Google.

Another reason that the FOSS community doesn't scrutinize Apple the way it needs to is that many of us are still operating on assumptions that no longer apply. Despite the dramatic reversal in Apple's fortunes in the last decades, many of us are still thinking about Apple as though we were still waiting for the millennium.

The same is true of perceptions of Microsoft, of course. But, in Microsoft's case, the failure to update perceptions matters less. While Microsoft is no longer denouncing FOSS as anti-American or communism, its basic wish to neutralize or assimilate the movement shows no more than token signs of changing. Only the tactics have changed, from denunciations to sponsoring and participation at FOSS conferences.

Summarizing, I give you a few useful tips for these, who decide to return the Microsoft Windows for a refund:

* It is rather not useful to phone the manufacturer, the retailer or Microsoft - would cost you money and nerves - write emails rather.
* You might shoot a photo documentation of declining the license, but that is not required.
* The most important letters to the manufacturer or the retailer are best to be sent with Recorded Delivery, return receipt is recommended too.
* If the licensing sticker is made of paper, it could be damaged very quickly (I recommend to photocopy it and not keep the laptop on your knees in the mean time).
* If you’re asked to return the licensing sticker, do not rip it off yourself (it is protected) - let the retailer do it.
* The Office of Fair Trading and Consumer Protection isn’t going to help much.
* Have patience, more patience and lots of patience

So Microsoft’s widely publicized “edgy” ad campaign, the one designed to counter the Apple (AAPL) ads that have so eroded its brand, is to feature Jerry Seinfeld as celebrity pitchman. And in many ways that does more to illustrate the sad differences between the two companies than the “Mac vs. PC” ads it’s designed to combat. Because Microsoft (MSFT) has chosen as quarterback for this campaign a tired ’90s sitcom star who not only used a Mac in the series that made him famous, but closed out Apple’s 1997 “Crazy Ones” ad–which, ironically, aired only once, during the series finale of “Seinfeld.”

So Microsoft, in an effort to overhaul its image and upstage the cool kids down in Cupertino, seems to have done little but confirm the message of its rival’s ads: “I’m a Mac, You’re a Dork,” or, in this case, a dated comedian. Really, the company might as well have hired Don Rickles for the job. Certainly, he would have come cheaper than the $10 million Seinfeld is rumored to have demanded. And there’s life left yet in that “What are you lookin’ at, you hockey puck?!” line of his.

La condena recayó sobre la firma Catedral Turismo, por usar programas sin licencias.

SAN CARLOS DE BARILOCHE (AB).- El juzgado Civil 5 condenó a la transportista local Catedral Turismo SA a pagar $ 30.834 a Micro$oft Corporation por el lucro cesante que le causó al utilizar varios programas de computación sin licencia.

La multinacional demandó a Catedral Turismo en u$s 6.809 por utilizar varios programas de computación de su propiedad intelectual sin pagar las respectivas licencias, y en u$s 4.207 por el "desprestigio comercial" ocasionado con tal accionar.

La demandada rechazó la acusación asegurando que adquirió las computadoras con los programas y las licencias, aunque no pudo probarlo. En su descargo sostuvo que Micro$oft "dolosa y negligentemente ha ejecutado una política abusiva y dominante al permitir mundialmente, durante mucho tiempo, el uso de programas sin licencia para cautivar a los usuarios y después obtener de ellos un rédito económico exorbitante, incurriendo en monopolio".

El juez Emilio Riat desestimó el argumento al señalar que "las razones de Catedral podrían considerarse en el ámbito legislativo para modificar la legislación vigente, pero no justifican el uso sin licencias en el régimen actual".

Al respecto sostuvo que "la tecnología informática se ha convertido en una necesidad social primaria para el individuo y las instituciones. Pero algo semejante ocurre con otras creaciones intelectuales tecnológicas muy difundidas, también protegidas por el monopolio temporario que justamente fomenta su desarrollo".

En su fallo Riat advirtió que "los programas de computación son obras susceptibles de propiedad intelectual en favor del autor" y que los usuarios "deben contar con licencia del autor" para su uso o reproducción.

El magistrado evaluó que "no existió un ejercicio abusivo del derecho por parte de Micro$oft ya que simplemente pretende cobrar por la obra intelectual utilizada sin permiso" y sostuvo que la exclusividad de la multinacional informática "no es ilícita ni justifica violar la propiedad intelectual".

También rechazó las dudas planteadas por la demandada sobre la razón social de Micro$oft para justificar el desconocimiento de la propiedad intelectual de los programas que utilizaba en sus oficinas.

En cambio rechazó el supuesto daño a la imagen o "desprestigio comercial" aducido por Micro$oft y la respectiva indemnización reclamada por ese concepto.

Catedral Turismo deberá abonar los $30.834, "más los nuevos intereses moratorios", a la demandante en el término de diez días y afrontar las costas del juicio que rondan los $ 14.000.

Microsoft acaba de presentar un nuevo portal de aplicaciones para Windows Mobile bajo el eslogan ‘DO MORE’ (Haz más) en un movimiento alarmantemente sospechoso. ¿Su nombre? Windows Mobile Apps ¿Su mayor virtud? 18.000 aplicaciones frente a las menos de 1.000 disponibles para el iPhone. ¿Su mayor defecto? Solo haber copiado el nombre sin tomar nada del espíritu de la App Store de Apple.

La página está basada en Silverlight y además de constituir un atentado contra el diseño, cuenta con una serie de carencias en lo que a usabilidad se refiere que la hacen completamente inútil. Puede que Microsoft tenga buenas intenciones al montar esto de forma ‘altruista’ y no solicitar ni un solo céntimo a los desarrolladores a cambio de hacer más visibles sus aplicaciones, pero también puede que se deba a que, en realidad, es poco probable que ningún usuario llegue a encontrar nada en una página que carece de algo tan esencial en los tiempos que corren como es un maldito buscador. ¿Y qué hay en su lugar? Un carrusel animado al más puro estilo flash por el que van desfilando las aplicaciones de cada categoría a un ritmo desesperantemente lento.

Siendo justos hay que admitir que Microsoft tiene en funcionamiento su propia tienda de aplicaciones desde hace bastante tiempo bajo el nombre de Windows Mobile Catalog pero llamadme paranoico si no es mucha coincidencia que decidan hacer borrón y cuenta nueva unos días después del lanzamiento de la App Store.

La funzione ActiveX Killbits, in grado di disabilitare i componenti nel caso siano state riscontrate vulnerabilità, offre ora una integrazione con Windows Update; Microsoft potrà quindi inviare un Killbit attraverso il sistema di aggiornamento automatico e bloccare così l'esecuzione di componenti obsoleti o potenzialmente pericolosi all'interno del browser. La Data Execution Prevention (DEP), sinora disabilitata in Internet Explorer per motivi di compatibilità con alcuni controlli ActiveX, verrà ora resa attiva e utilizzata di default sotto Windows XP SP3 e Windows Vista SP1.
